Judge Barton ruled there was enough evidence against Joshua Tough to charge him with felony murder and first degree child abuse.

On April 7th, 2014, the three-week old boy died from injuries he suffered from the alleged abuse he endured at the hands of Tough.

Joshua Tough is scheduled for a Circuit Court arraignment on September 15th, 2014.

18-year-old, Kirsten Marie Richardson, the infant’s mother, has been charged with second degree child abuse. She waived her preliminary exam and is also scheduled to appear in Circuit Court on September 15th, 2014.

Officers were called to a home on April 3rd, 2014 in Bismarck Township shortly after 8 p.m. on a report that the three-week-old infant had stopped breathing.

The infant was transported to Alpena Regional Medical Center with head and internal injuries.

The child’s injuries were determined to have been caused by a non-accidental event.

The baby’s mother, Kirsten Marie Richardson, and her boyfriend,  Joshua Alan Tough, were the only individuals with the 3 week old boy at the time of the incident.

The infant died at Covenant Hospital in Saginaw after he was transported there from Alpena Regional Medical Center.

During the hearing, Judge Barton heard testimony from a forensic pathologist who said the infant died of blunt force trauma to the head.

Presque Isle County Sheriffs Detective Joe Mulka testified that there were several inconsistencies in Tough’s statements regarding the case.
